TERMS & CONDITIONS

ANTHEM CONDITIONS OF SALE POLICY

Anthem Auction & Appraisal, LLC (hereafter “Anthem”) is dedicated to providing descriptions that are thorough and accurate, and that reflect our belief in service through honesty and attention to detail.

  1. All items are sold AS IS, WHERE IS with or without any and all faults. When goods are put up in lots, each lot is the subject of a separate sale. A sale by auction is complete when the auctioneer so announces by the fall of the hammer or in other customary manner, and the successful bidder becomes the purchaser or buyer, and at this time ALL SALES ARE FINAL. The purchaser immediately assumes full risk and responsibility for the purchased lot(s).

  2. Auction catalogs are furnished by Anthem as a guide only. Anthem makes no guarantee or warranty, expressed or implied as to the accuracy of descriptions, although catalog information was obtained from sources in good faith.

  3. A buyer’s premium will be added to the successful bid price and is payable by the purchaser as part of the total purchase price. The buyer’s premium (for bids made in person, by phone, or email) is 15% of the successful bid price of each lot. Note: Buyer’s Premium for all bidding through Proxibid.com is 20% of the successful bid price of each lot.

  4. Payment: Complete payment is required on sale day only. Anthem accepts Cash, Visa and Mastercard or a Check accompanied with a bank letter, guaranteeing the payment of funds to Anthem Auction & Appraisal, LLC. Current identification (valid driver’s license, state ID or Passport) and a valid credit card are required at the time of registration. Lots and items may not leave the premises until payment in full is made. If payment has not been initiated within 2 days after the auction, Anthem reserves the right to charge the credit card on file.​

  5. Sales Tax: Buyers are required to pay state and local sales tax unless exempted by law. If exempt, buyers must file a tax exemption form with Anthem before any exemption can be made.​

  6. Property is open to thorough public inspection. It is the buyer’s responsibility to determine condition, age, genuineness, or any other determinative factor. Do not bid unless you have determined the condition of the lot from your own examination. A buyer shall be the sole judge of value. Anthem may attempt to describe the merchandise in advertising, on the Internet, and at the auction but makes no guarantees. Buyers who bid from off site and are not present at the live auction or preview, understand and acknowledge that they may not be able to inspect a lot or item as well as if they were to examine it in person. Additionally, antiques, by the very nature of their age, have wear that reflects their years of use. As a result, honest wear earned from use is to be expected and is sometimes the proof that an item is an antique. Normal wear will not be listed.

  7. Disputed & Rejected Bids: The auctioneer reserves the right to reopen the bidding on any disputed lot. The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer is the sole determinant of accepted or rejected bids and successful buyers. Where a bid is made while the hammer is falling in acceptance of a prior bid, the auctioneer may in his/her discretion, reopen the bidding or declare the goods sold under the bid on which the hammer was falling. The auctioneer also reserves the right to reject nominal bids and to withdraw from the auction items that do not receive a bid reflective of an item’s worth. Some of the items in this auction are subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and Anthem. We make every attempt, for the benefit of both seller and buyer, to represent lots as accurately as possible.

  8. Withdrawn Lots: Anthem reserves the right to withdraw any property before the auction and shall have no liability whatsoever for withdrawal of the property.

  9. The buyer assumes all liability whatsoever resulting from the possession, use, or disposition of items purchased. The buyer also agrees to release, waive all rights against, indemnify, and hold harmless the auctioneer and sellers.

  10. Lot Removal: Clients are invited to pick-up purchased items the auction location within 48 hours of the completion of the auction. If you are unable to pick up, please refer to our list of recommended shippers (available on request). It is your responsibility to arrange shipment with a shipper and pay them directly for the shipment of your items. Once you have arranged shipping, please let us know to whom we should release your items. Anthem is in no way responsible for the acts or omissions of independent contractors, packers or carriers of purchased items. The buyer acknowledges he/she has read and agrees to be bound by the terms and conditions set forth in Anthem’s policy. We would like to thank you for your interest and participation. Anthem takes our responsibilities to buyers and sellers very seriously. We appreciate an opportunity to serve you.

 

These Conditions of Sale shall be governed and interpreted by the laws of the State of Nebraska. Should any portion of these Conditions of Sale be found to be invalid, illegal, or unenforceable in a local jurisdiction, that part shall be nullified and the rest of the Conditions of Sale shall continue to be valid to the fullest extent permissible by law.
